Administration of Deceased Estates
The administration of estates can be a very time consuming
process. At Cunningham Coates Stockbrokers our experienced
practitioners are familiar with the intricacies specific
to the administration of estates.
Probate Valuation
Cunningham Coates Stockbrokers have extensive resources
to produce probate valuations accurately and in line with
Inland Revenue regulations. Where required this will take
account of any corporate actions which may have occurred,
checking the validity of certificates and tracing the history
of holdings to explain any discrepancies.
Estate Administration
Once the Executors’ decisions have been made Cunningham
Coates Stockbrokers can take care of the process from registering
Letters of Administration with the individual company registrars
for all holdings (for portfolios held through our Nominee
Service probate need only be registered with ourselves) to
carrying out the sales from the estate. Interest will be
paid on any cash held on deposit. On transferring ownership
to the beneficiaries, beneficiaries can choose to retain
certificates or take advantage of our Nominee Services. We
can also provide guidance and advice to beneficiaries on
managing their investments.
Trusts
The Trustee Act (NI) 2001 has expanded the range of investment
classes that can be held within a Trust and has introduced
new rules governing a Trustee’s duty of care. Cunningham
Coates Stockbrokers have considerable experience in all types
of trusts including Interest in Possession Trusts, Discretionary
Trusts and Bare Trusts.
We can assist Trustees in meeting their obligations through
managing the investments on a Discretionary basis. The investment
decisions are then made on behalf of the Trust in line with
the Trustee’s objectives and risk profile. Alternatively,
the Trustees can demonstrate that they are seeking appropriate
advice through us via the Advisory Nominee Service. Capital
& income is kept separately and can be paid out to beneficiaries
or retained on deposit as per the Trustees’ instructions
and the Trust administration can then be easily audited.
